The Supreme Court just opened the door for brokers to be hit with nuclear ($10M+) or even thermonuclear ($100M+) jury verdicts in transportation cases. The Court also provided the risk management path: just ask the hard questions.

Renaissant validates the actual driver who is picking up the load, ensuring they have the proper CDL for the trip. The industry problem

Fraud is up. Theft is up. Public safety is a problem. The duty of care has changed.

Cargo theft losses hit $725 million in 2025, a 60% jump in one year (Verisk CargoNet), with strategic fraud from double-brokering, identity spoofing, and chameleon and ghost carriers driving the surge.

Public-safety pressure is mounting alongside it. 5,375 large trucks were involved in fatal crashes in FMCSA’s most recent full-year report. The USDOT has moved to remove 194,000 non-domiciled CDL holders from the freight market. And the Supreme Court’s unanimous ruling in Montgomery v. Caribe now extends negligent-hiring liability to brokers for the drivers behind the wheel. That responsibility is unlikely to stop with carriers and brokers. It will soon also be the responsibility of the shipper.

Until now, the industry has had two basic answers. One: analyze the carrier, which ignores the driver. Two: throw more people at the problem, which is slow, expensive, and still doesn’t validate the actual driver.
